When a person dies without a Will, an application for a "Declaration of Heirs" must be made to the court. In such request it is stated, under oath, that as far as is known there was no Will and that the heirs are those included according to the law. In this way, the "intestate" inheritance will operate, that is to say, without a Will, in which the heirs inherit in equal parts.
